Liens Against the Title

Sometimes when homeowners who are selling their home are surprised to learn their is a lien on their title.  There are several types of liens, mortgages, mechanic's or contractor's liens, etc

The lien must be paid in order to convey title.   If the owner wants to challenge the lien, it can be released by the seller posting a bond, pending adjudication.  Some types of liens that a title search may find are claims against the property by an ex-spouse or long-ago heir of a former owner.   A quitclaim deed can be used to clear up these issues.  By signing the deed, you are signing over all rights to the property.

It is not uncommon for a  real estate transactions involve at least some minor issues on the part of either the buyer or the seller. This is where an experienced real estate agent can provide solutions to resolve the so the sale closes smoothly.
